ALL RESERVATIONS ARE CONSIDERED UNCONFIRMED BOOKINGS UNTIL WE HAVE RECEIVED YOUR DEPOSIT. CERTAIN AVAILABILITY RESTRICTIONS MAY APPLY DURING HIGH SEASON AND HOLIDAY WEEKS.

AGENCY: Tenant, by this document, is given notice that Duncan Real Estate is agent for the Owner and is being compensated as such by the Owner. Tenant acknowledges that this written notice was given, and is understood, prior to signing Rental Agreement, in compliance with all applicable Florida Statutes.

RESERVATION DEPOSITS: The minimum reservation deposit is $250.00. Reservation deposits are non-refundable without 90 day written notice. A $50.00 cancellation fee will be charged. Reservations of 28 days or greater will be charged a $25.00 reservation fee.

RENT: All rental fees are due 30 DAYS PRIOR TO ARRIVAL, payable by check, money order, cash or traveler's check. Credit cards are not accepted.

TAX: Rentals of six months or less are subject to Florida Sales Tax and Manatee County Resort Tax.

TRAVEL INSURANCE: We provide the option of CSA Travel Protection Plan for U.S. and Canadian and U.K. residents. If eligible, CSA Travel Protection Plan is automatically added to your invoice. The Plan is effective on the day your payment is received. Call CSA with any insurance questions, 1-866-999-4018.

REFUNDS: NO REFUNDS will be made due to inclement weather, early departure or no shows.

POSSESSION: Upon arrival, pick up keys at Duncan Real Estate. Check in is between 3:00 P.M. and 5:00 P.M. unless otherwise arranged with management. Check out is by 10:00 A.M. on day of scheduled departure. Please notify the Office if planning to arrive after 5:00 P.M. (4:00 P.M. on Sunday); your keys will be left in the key pick up box at front office door.

OCCUPANCY: Occupancy is limited to number of people stated on the Rental Agreement. Over occupancy can result in immediate eviction without refund.

HOUSEKEEPING: Accommodations are to be maintained in a neat and clean condition. Paper and toiletry items are the responsibility of the renter. TOWELS are to be laundered by the Tenant. It is understood that last minute bed and bath linens may be left for housekeeping upon departure.

TELEPHONE:   Most properties are provided with a telephone for Tenant use. Local calls are free. All other calls are to be charged to Tenants home, calling card or collect. 

DAMAGE/SECURITY DEPOSIT: Any damages, excessive cleaning charges, long distance telephone charges and outstanding utilities will be deducted from this deposit. If applicable, this deposit shall be returned, by mail, after a satisfactory inspection of the rental property. Allow three weeks for refund of this deposit.

RADON GAS: Radon is a naturally occurring gas that, when it has accumulated in a building in sufficient quantities may present a health risk to persons who are exposed over time. Levels that exceed federal and state guidelines have been found in buildings in Florida.

Anyone occupying a unit governed by a homeowners or condominium association shall abide by all association rules and regulations. Guest shall not be permitted occupancy unless association approval is obtained.

If the property is or becomes listed for sale Realtors may enter the premises with 24 hour notice to guest. Duncan Real Estate may enter the premises at anytime to preserve and maintain the premises. Duncan Real Estate reserves the right to relocate a tenant to an alternate property of similar quality, for whatever reason.

Duncan Real Estate shall not be liable to guest or any other person for any damages to property or for injury to persons upon the premises for any cause whatsoever, including, but not limited to, defects in the premises or otherwise. Guest shall indemnify and hold harmless Duncan Real Estate from and against any and all liabilities, claims, expenses, fees, loss of use and every kind and nature arising out of Guest’s use and occupancy of premises.
